Terms of Use for the SureConsult Training Platform (the “Platform”)
THE USER SHALL READ THESE TERMS OF USE ("TERMS OF USE") CAREFULLY BEFORE COMPLETING THE REGISTRATION. BY USING THIS PLATFORM AND COMPLETING THE REGISTRATION, THE USER IS DEEMED TO HAVE ACCEPTED AND AGREED TO BE BOUND BY THESE TERMS OF USE. IF THE USER DOES NOT ACCEPT THESE TERMS OF USE, DO NOT REGISTER OR USE THIS PLATFORM.
These Terms of Use apply to the use of the Platform for the purposes of accessing training and training materials, including the use of any of the information provided on the Platform. In using the Platform, the User agrees to be bound by these Terms of Use. SureConsult reserves the right to modify the Terms of Use at any time and any such modifications shall become effective immediately. The User’s continued use of the Platform, after the Terms of Use have been modified, shall constitute the User’s acceptance of the modified Terms of Use.
1. Enrollment
Each training course on the Platform may have different content, different geographical jurisdictions and different validity dates. It is the User’s sole responsibility to verify the Course Description prior to enrollment and to understand the specific details of the course. No refunds will be provided after enrollment in a specific course has been completed.
2. Information on the Platform
The information contained on the Platform is provided “as is” for training and reference purposes only.
3. Training and Training Materials
The training and training material on the Platform is based on industry standards, global regulations, best practices, fluid guidance and airline and airframe manufacturer procedures that were current at the time of development of the content. It is the sole responsibility of the User to ensure that the procedures employed in actual operations comply fully with all applicable local regulations, standards, and programs.
4. Disclaimer and Indemnity
SureConsult does not accept any responsibility for any loss or damage, caused directly or indirectly, arising from the User’s use of the Platform, including reliance on any information contained on the Platform. To the extent permissible by law, SureConsult hereby disclaims all conditions and warranties. The User shall fully indemnify, defend and hold SureConsult, its directors, officers and employees harmless from and against all claims, actions, demands, costs, losses or damages, whether direct, indirect or consequential, and reasonable attorney fees and expenses, arising out of or in connection with third-party claims arising from the User’s failure to comply with these Terms of Use.
5. Privacy Policy
The User and SureConsult agree to comply with SureConsult’s Privacy Policy.
6. Confidentiality and Data Privacy
The information contained on the Platform is confidential. If any personal information is shared with third parties, it must only be done so on a need to know basis, with appropriate safeguards and in accordance with applicable laws and regulations.
7. Intellectual Property Rights
The contents of the Platform including, but not limited to training programs, lessons, exams, videos, tutorials, workbooks, text, graphics, logos and icons, are copyrighted materials owned by SureConsult, including its affiliates or subsidiaries. SureConsult and other unique record locators (URL) and or other SureConsult and SureOps logos and product and service names are trademarks of SureConsult, which are protected by applicable laws of certain countries. All rights are reserved. The User must not modify, decompile, or reverse engineer any software or content that SureConsult discloses to the User via this Platform, and the User must not remove, overprint, or deface any notice of copyright, trademark, logo, legend, or other notice of ownership from any originals or copies of software from the Platform. "SureConsult Trademarks" means all names, marks, brands, URL names or addresses, logos, designs, trade dress and other designations SureConsult uses in connection with its Products or Services, including this Platform. The User is not permitted to incorporate any SureConsult Trademarks into any other trademarks, service marks, company names, Internet addresses, domain names, or any other similar designations. Any unauthorized use of any materials contained on this Platform may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes.
8. No Waiver
The failure of SureConsult to exercise or enforce any right or provision of these Terms of Use does not constitute a waiver of such right or provision.
9. Governing Law
These Terms of Use shall be governed by the laws of the Province of Quebec. Any dispute arising out of or in connection with these Terms of Use shall be referred to and finally resolved by arbitration administered by the AAA Rules, which rules are deemed to be incorporated by reference into this clause. The seat of arbitration shall be Montreal, Quebec.
These Terms of Use shall be governed by the laws of the province of Quebec and the applicable laws of Canada, excluding conflict of law provisions. Any dispute resulting from these Terms of Use shall be exclusively settled by the courts of the province of Quebec, Canada.
